These Terms of Service (“Terms”) govern your access to and use of the Heartz Aligned website, mobile application, services, features, and related platforms (collectively, the “Service”). By creating an account or using Heartz Aligned, you agree to these Terms. If you do not agree with any part of these Terms, please do not use the Service. 1. Eligibility Heartz Aligned is intended for adults who are 18 years of age or older. By registering, you confirm that: You are at least 18 years old. You have the legal capacity to enter into these Terms. The information you provide is accurate and truthful. You are not prohibited by applicable law from using an online dating or social networking service. We reserve the right to suspend or terminate accounts where we reasonably believe that a user does not meet these requirements. 2. Creating Your Account You may need to create an account to access certain features of Heartz Aligned. You agree to: Provide accurate and current information. Maintain the accuracy of your profile information. Keep your login credentials confidential. Not create an account for another person without authorization. Not create multiple accounts for deceptive or abusive purposes. Notify us if you believe your account has been accessed without your permission. You are responsible for activity carried out through your account. 3. Your Profile Heartz Aligned allows you to create a personal profile that may include photographs, interests, location, preferences, biography, and other information. You are responsible for the content you upload or publish. You must not upload content that: Is false, fraudulent, misleading, or impersonates another person. Belongs to someone else without permission. Contains unlawful, threatening, abusive, hateful, or harassing material. Contains sexually explicit or exploitative content. Promotes illegal activities. Attempts to scam, defraud, or manipulate other members. Violates another person's privacy or rights. You should only upload photographs and other content that you have the right to use. 4. Connecting With Other Members Heartz Aligned provides tools that may help you discover other members, including profile discovery, Encounters, search filters, messaging, and other communication features. Heartz Aligned does not guarantee that you will find a particular type of relationship, receive a response from another member, or establish a successful relationship through the Service. You are responsible for your interactions with other users. Please exercise good judgment when communicating with people online and avoid sharing sensitive personal information unnecessarily. 5. Messaging and Communication Heartz Aligned may provide private messaging, audio calls, video calls, emojis, GIFs, stickers, gifts, and other communication features. You agree to use these features responsibly and respectfully. You must not use Heartz Aligned to send spam, scams, malicious links, unwanted commercial solicitations, abusive messages, or other prohibited content. We may investigate reports of abuse or violations of these Terms and may take appropriate action, including restricting or terminating an account. 6. Credits Heartz Aligned may offer virtual credits that can be purchased using supported payment methods. Credits may be used for eligible features such as virtual gifts, stickers, or other services made available on the platform. Credits: Have no cash value. Cannot be exchanged for cash. Cannot be transferred between users unless expressly permitted by Heartz Aligned. Cannot be resold. Are not a bank account, deposit, or financial instrument. The number of credits required for a particular feature or item may change from time to time. 7. Gifts and Stickers Heartz Aligned may allow users to send virtual gifts and stickers to other members. Virtual gifts and stickers are digital items provided within the Service and do not represent physical goods. Once credits have been used to send an eligible virtual item, the transaction may not be reversible except where required by applicable law or expressly provided by our refund policy. We reserve the right to modify, remove, replace, or introduce virtual items and their credit prices. 8. Premium Plans Heartz Aligned may offer Premium membership plans with different durations, including daily, weekly, monthly, half-year, yearly, and lifetime options. Premium features may include benefits such as: Ad-free browsing. Incognito browsing. Seeing who likes you. Special pricing on selected virtual items. Other Premium benefits introduced from time to time. The features included in each Premium plan will be displayed before purchase. We reserve the right to modify Premium features, provided that changes do not unlawfully affect benefits already purchased. 9. Payments Payments for credits, Premium plans, or other paid services are processed through supported third-party payment providers. Depending on your location, available payment methods may include services such as Paystack, PayPal, Stripe, Razorpay, CoinGate, or other payment providers supported by Heartz Aligned. Payment providers may have their own terms and privacy policies. You agree to provide accurate payment information and authorize the applicable payment provider to process your transaction. Prices displayed on the platform are subject to change. The price applicable to your purchase will normally be displayed before you confirm the transaction. 10. Refunds Purchases of digital credits, virtual gifts, stickers, and Premium services may be subject to our refund policy and applicable consumer protection laws. Where a purchase has already been consumed or a digital service has already been delivered, refunds may not be available except where required by applicable law. If you believe you were incorrectly charged, please contact Heartz Aligned support with details of the transaction. 11. Prohibited Activities You agree not to use Heartz Aligned to: Harass, threaten, stalk, or intimidate another person. Defraud or scam other users. Impersonate another person or organization. Create fake identities for deceptive purposes. Send spam or unsolicited commercial messages. Attempt to obtain another user's password or account information. Upload malicious software or harmful code. Circumvent security or access restrictions. Scrape, copy, or collect user information without authorization. Use the platform for unlawful purposes. Exploit or endanger minors. Engage in activities that violate applicable laws. We may suspend or terminate accounts involved in prohibited activities. 12. User Safety Online interactions involve inherent risks. Although we provide tools and features intended to support a positive dating experience, we cannot verify every statement, photograph, identity, intention, or claim made by every member. You are responsible for making your own decisions about who you communicate with and meet. When meeting someone for the first time, consider meeting in a public place, informing someone you trust about your plans, and taking reasonable precautions to protect your personal safety. If another member makes you uncomfortable or violates these Terms, use the available reporting tools or contact our support team. 13. Reporting and Moderation We may provide tools for reporting profiles, messages, or other content that violates our Terms. When we receive a report, we may review the relevant information and take action where appropriate. Possible actions include: Removing content. Restricting features. Suspending an account. Permanently terminating an account. We may also cooperate with lawful requests from relevant authorities where required. 14. Account Suspension and Termination You may stop using Heartz Aligned at any time and may delete your account through the available account settings or by contacting support where applicable. We may suspend or terminate your account if: You violate these Terms. You provide false or misleading information. Your activity creates a risk to other users or the platform. Your account is involved in fraud, abuse, or unlawful activity. We are required to do so by law. Continued access to the Service is no longer commercially or technically feasible. Termination may result in the loss of access to your account, profile, credits, virtual items, or other platform features, subject to applicable law and any applicable refund rights. 15. Intellectual Property The Heartz Aligned name, logo, branding, website design, software, graphics, text, and other platform materials are owned by or licensed to Heartz Aligned and are protected by applicable intellectual property laws. You may not reproduce, modify, distribute, sell, or commercially exploit our intellectual property without prior written permission. You retain ownership of content that you lawfully upload to Heartz Aligned. By uploading content, you grant Heartz Aligned the necessary license to host, display, reproduce, and process that content for the purpose of operating and providing the Service. 16. Third-Party Services Heartz Aligned may integrate with third-party services such as payment providers, social login providers, mapping services, communication services, analytics providers, and other technology platforms. Third-party services may have their own terms and privacy policies. Heartz Aligned is not responsible for the independent operation, availability, or policies of third-party services. 17. Availability of the Service We aim to keep Heartz Aligned available and reliable, but we do not guarantee that the Service will always be uninterrupted, error-free, or available. Maintenance, upgrades, technical problems, security incidents, internet failures, or circumstances beyond our reasonable control may temporarily affect the Service. 18. Disclaimer Heartz Aligned provides an online platform for discovering and communicating with other people. We do not guarantee the identity, intentions, character, compatibility, or conduct of any member. We do not guarantee that using the Service will result in friendship, romance, marriage, or any particular relationship outcome. You use the Service at your own discretion and risk. 19. Limitation of Liability To the maximum extent permitted by applicable law, Heartz Aligned and its owners, operators, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or other losses arising from your use of the Service or interactions with other members. Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law. 20. Changes to These Terms We may update these Terms from time to time to reflect changes to our services, features, business practices, or legal requirements. When we make material changes, we may provide notice through the website, application, email, or other appropriate means. Your continued use of Heartz Aligned after updated Terms become effective constitutes acceptance of the revised Terms. 21.
